(6) “Tobacco product” – Any product containing, made, or derived from tobacco that is intended for human consumption, whether chewed, smoked, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means including but not limited to cigarettes, cigars, snuff, e-cigarettes and any other items resembling tobacco or tobacco products, and other kinds and forms of tobacco. A tobacco product excludes any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product, as a tobacco dependence product, or for other medical purposes, and is being marketed and sold solely for such an approved purpose. (c) Areas in Which Smoking and Tobacco Products are Prohibited (1) Smoking and the use of tobacco products are prohibited on any grounds of the Town of Morrisville’s parks and greenways system. (2) In any facilities located in the Town of Morrisville’s parks system. (3) Smoking and the use of tobacco products are prohibited on grounds of the Town’s parks system and in buildings located in the Town’s parks system while being used for private events. (d) Implementation Requirements (1) The Town shall post signs that meet all the requirements in Section (e) of this ordinance. (2) The Town shall remove all ashtrays and other smoking receptacles from the grounds of Town’s parks system and the buildings located in the Town’s parks system. (e) Signage The signs required by Section (d) must: (1) State in English that smoking and the use of tobacco products are prohibited or that the parks, buildings and greenways are tobacco free and includes the universal “No Smoking and Use of Tobacco Products Prohibited” symbol. (2) Be of sufficient size to be clearly legible to a person of normal vision, and be conspicuously posted. (3) Be posted at each entrance of the buildings located in the Town’s parks system and in other locations within the buildings reasonably calculated to inform employees and the public of the prohibition. (4) Be posted on the grounds of the Town’s parks system in locations and at intervals reasonably calculated to inform employees and the public of the prohibition. (f) Enforcement (1) Violation of this ordinance shall subject the violator to a civil penalty in the amount of twenty-five dollars ($25). (2) A civil penalty may be recovered by the Town in a civil action in the nature of debt, if the violator does not pay the Town within 30 days after the date of the violation notice.
