Sec. 50-1. Construction debris.
(1) All construction refuse, lumber and debris shall be removed or caused to be removed by the property owner within ten days from the completion of any construction activity.
(2) If any person while transporting or hauling any garbage, trash, rubbish or excavation material from a construction site shall throw, drop, or deposit or allow to be thrown, dropped or deposited any such material from the transporting vehicle, such person shall promptly clean up and remove the rubbish or materials in a manner satisfactory to the town manager. If such person fails to do so, the town may clean up and remove the rubbish and material and collect the cost of such cleanup and removal from the person violating this section. (3) Violation of this section shall subject the offender to a civil penalty in the amount of $50.00 per violation. Each day's continuing violation shall be a separate and distinct offense. The penalty shall be due and payable within seven days after the violator has been notified by the town of the penalty. Payment of any such civil penalty shall be in addition to any amount paid to the town for the cost of trash cleanup or removal. Violation of this section may also constitute a violation as outlined in G.S. 14-399. (Ord. of 1-12-87, §§ 1 — 3; Ord. No. 2023-6-0, 3-14-23)
