ARTICLE II.
TAXICABS AND RIDESHARES
Sec. 67-31. Purpose.
The purpose of this article is to protect the public health, safety and welfare of the residents of the town when using taxicab and rideshare services and to promote the orderly development and maintenance of safe and reliable privately operated taxicab transportation service in the town. Sec. 67-32. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
(1) Chief means the chief of police of the town and their designee(s). The chief is responsible for the administration of this chapter.
(2) Driver means any person driving a taxicab, either as an owner or under the direction, employment, control, or service of the owner as herein defined.
(3) Owner means every person having control, whether by outright ownership, lease, or otherwise of any taxicab for hire.
(4) Operating permit means the permit, issued by the chief of police or their designee, under which a person may operate a passenger vehicle for hire.
(5) Permit means an operating permit and a driver's permit, as the context requires.
(6) Person includes both singular and plural, and means and includes any individual, firm, corporation, association, partnership or society, exclusive of public agencies.
(7) Rideshare services (such as Lyft and Uber) are defined in G.S. Chapter 20, Article 10A โ Transportation Network Companies โ as Transportation Network Companies (TNC).
(a) A rideshare or TNC service is defined as โ Prearranged transportation service provided by a TNC driver in connection with a transportation network company. The TNC service begins when the TNC driver accepts a ride request on the transportation network company's online-enabled application or platform and ends at the later of the following:
1)
The time that the driver completes the transaction on the online-enabled application or platform.
2)
The time that all passengers exit the vehicle and complete unloading of the
