Sec. 3-1. Applicability of Wake County Ordinance.
(1) Except as provided herein, the Wake County Ordinance Prohibiting Discrimination in Public Accommodations and employment (Non-Discrimination Ordinance) shall apply within the corporate limits of the Town of Morrisville that are located within Wake County and shall have the same force and effect and shall be enforced to the same extent within the corporate limits of the Town as within Wake County. Wake County shall be authorized and permitted to enforce the provisions of the Wake County Non-Discrimination Ordinance within the corporate limits of the Town of Morrisville that are located within Wake County pursuant to G.S. 153A-122, to the fullest extent allowed by law. (2) Section 34.03(B) of the Wake County Non-Discrimination Ordinance concerning bids or proposal submitted to Wake County shall not apply to the Town of Morrisville or within the Town’s corporate limits. Except as provided herein, all provisions of the Wake County Non-Discrimination Ordinance shall apply without restrictions. (Ord. No. 2022-96-0, 3-22-22)
Sec. 3-2. Definitions.
For the purpose of this Chapter, the following definitions shall apply:
(1)
Conciliation means attempted resolution of issues raised by a complainant through informal means not involving court process.
(2) Discrimination means any difference in treatment based on a Protected Class as defined herein.
(3) Employer means any person employing one or more persons within the Wake County and any person acting in the interest of an employer, directly or indirectly, including an employment agency. “Employer” shall include Wake County and any Wake County Contractor. (4) Gender identity or expression means having or being perceived as having gender- related identity, expression, appearance, or behavior, whether or not that identity, expression, appearance, or behavior is different from that traditionally associated with the sex assigned to that individual at birth.
(5)
Person means a natural person, a corporation, company, partnership, firm, association or other entity with a separate legal existence.
(6) Protected class means race, natural hair or hairstyles, ethnicity, creed, color, sex, pregnancy, marital or familial status, sexual orientation, gender identity or expression, national origin or ancestry, National Guard or veteran status, religious belief or non-belief, age, or disability.
