4.7.8

Exempt Plat Certification

CERTIFICATE OF EXCEPTION FROM SUBDIVISION ORDINANCE

I hereby certify this plat is exempt from the subdivision ordinance under definitions of subdivision contained in NC General Statutes and the Town of Morrisville Unified Development Ordinance (UDO) for the following reason: (Select appropriate reason)

The combination or recombination of portions of previously subdivided and recorded lots, where the total number of lots is not increased and the resultant lots meet or exceed the lot standards set forth in the UDO;

The division of land into parcels greater than ten acres where no street right-of-way is involved; The public acquisition of land for the opening or widening of streets or for public transportation corridors;

The division of a tract in single ownership whose entire area is no greater than two acres into not more than three lots, where no street right-of-way dedication is involved and where the resultant lots are equat to or exceed the lot standards set forth in the UDO; or The division of a tract into parcels in accordance with the terms of a probated will or in accordance with intestate succession under Chapter 29 of the NC General Statutes.

Review Officer Certification Surveyor’s Certificate and Seal Certifying the Following

SURVEYOR’S CERTIFICATE AND SEAL CERTIFYING THE FOLLOWING: A. That the survey creates a subdivision of land within the area of a county or municipality that has an ordinance that regulates parcels of land; B. That the survey is located in a portion of a county or municipality that is unregulated as to an ordinance that regulates parcels of land; C. Any one of the following: i. That the survey is of an existing parcel or parcels of land or one or more existing easements and does not create a new street or change an existing street; ii. That the survey is of an existing feature, such as a building or other structure, or natural feature, such as a watercourse; iii. That the survey is a control survey; or iv. That the survey is of a proposed easement for a public utility as defined in NC General Statutes 62-3. D. That the survey is of another category, such as the recombination of existing parcels, a court-ordered survey, or other exception to the definition of subdivision; E. That the information available to the surveyor is such that the surveyor is unable to make a determination to the best of the surveyor’s professional ability as to provisions contained in A through D above.

CERTIFICATE OF TOWN OF CARY ACKNOWLEDGEMENT OF OFFER OF DEDICATION

I, _________________, Town Clerk/Deputy Town Clerk of Cary, NC certify that the Town of Cary acknowledges the offer of dedication of the streets, easements, rights of way and public parks shown herein to the public, but the Town of Cary assumes no responsibility to accept, open or maintain the same until it is in the public interest to do so and action is taken by the Town of Cary to accept said offer of dedication.
