Article 5: Development Standards Section 5.11. Utilities and Services 5.11.1. General
SECTION 5.11. UTILITIES AND SERVICES
5.11.1. General
A. Compliance with Provider Standards All utility lines and facilities — such as, but not limited to, those providing sewage disposal, drinking water, nonpotable reclaimed water, electric power, natural gas, telecommunication, or cable television service — shall be located, designed, and constructed or installed in accordance with the standards of the utility entity providing the utility service as well as all Town Ordinances, Policies and Manuals and the requirements set forth herein below. Generally All utility lines and facilities shall be installed in such a manner and at such a time as to minimize interference with other utility lines and facilities, disruption of roadways or other infrastructure improvements, and disruption of vehicular or pedestrian traffic, and to facilitate maintenance of the utility lines and facilities without undue damage to infrastructure improvements. a. Generally In all new development, electric distribution feeder lines and all other utility lines located on the development site and/or along the public right-of-way abutting the site shall be installed underground unless the Town Engineer waives this requirement in response to demonstration that undergrounding the line is not feasible due to non-compliance with a utility com pany’s conversion policy or will be detrimental to the overall safety and/or reliability of the circuit or utility system or street right-of-way. b. Easements (1) Any easements required to accommodate the immediate or future conversion of existing overhead utility lines shall be provided prior to the issuance of the first building permit. (2) The location and width of any required easements shall be determined by the utility companies with existing equipment on the site and in the right-of-way abutting the site B. Installation 1. 2. Exemptions
c.
The following forms of new development are exempt from the requirement to install existing overhead utility lines underground:
(1) Transmission lines with a voltage of 115kV or greater;
(2) Wireless telecommunication facilities which are subject to the standards in Section 2.5.26;
(3) Individual single-family homes not associated with a new Type I or Type II Preliminary Plat.

5.11.2. Public Sewer and Water
A. Development with public sewer and potable and reclaimed water are conditioned on the availability of sufficient sewer or water capacity in the Town of Cary sewer and/or water systems to serve the proposed development. 1. If sufficient sewer and/or water capacity for the proposed development is available, then sewer and/or water lines and facilities for the development shall be connected to the Town of Cary sewer
