Article 5: Development Standards Section 5.16. Signage 5.16.3. Sign Maintenance

3. Prohibited Locations In addition to the setback requirements in this Ordinance, and other restrictions of this section, no sign shall be located in any of the following locations: a. In, on, or over public rights-of-way, which, in addition to streets, may include other elements, such as sidewalks, parkways, retaining walls, utility poles, traffic control devices, medians, and center islands, but excluding: (1) Traffic control signs installed by a governmental entity or which are required to be installed by a governmental entity. (2) Signs posted by governmental entities that support emergency management, such as wayfinding to disaster relief locations. (3) Banners posted by the Town on utility or light poles according to Section 5.16.6.B.1, Light Pole Banner Signs. (4) Signs constructed by the Town or another governmental or quasi-governmental entity pursuant to terms and conditions set forth in an intergovernmental agreement with the Town. (5) Signs authorized by agreement with the Town Council. (6) Signs located in a State-maintained right-of-way pursuant to and in accordance with N.C.G.S. 136-32. (7) Political signs located in a Town-maintained right of way pursuant to and in accordance with Section 5.16.C.9. (8) Projection fascia, bracket-mounted and awning signs in compliance with sections 5.16.4. b. In places that have less horizontal or vertical clearance from authorized communication or energized electrical power lines than that prescribed by Federal, State, or local law, rule, or regulation. c. Within easements for overhead utilities without the utilities’ express written consent. d. Signs placed on a roof, or projecting above a roofline, unless the projection is no more than 50 percent above the deck of a flat roof when installed on a parapet wall. 5.16.3. Sign Maintenance Signs and sign structures of all types, including temporary signs, shall be maintained as provided in this section. A. Abandoned Signs 1. Signs shall display messages. Signs that do not display a message for a period of more than 30 days are abandoned, and any subsequent use of the abandoned sign shall comply with the provisions of this section. 2. In accordance with N.C.G.S any political signs remaining 30 days past the day of the associated election shall be considered an abandoned sign and may be removed and disposed of without penalty. The same shall apply to any temporary sign remaining 30 days past the date of the event that the sign was associated with. B. Paint and Finishes Paint and other finishes shall be maintained in good condition. Peeling finishes shall be repaired. Signs with running colors shall be repainted, repaired, or removed if the running colors were not a part of the original design.
