Article 2: Administration Section 2.5. Application-Specific Review Procedures 2.5.6. Subdivision Approvals
Approval in accordance with Section 2.4.8.D, Modification or Amendment of Approval: (i) A change in a condition of approval; and (ii) An increase in the number of lots.
3. Preliminary Plat Approval Review Standards An application for Type 1 Subdivision Preliminary Plat Approval or a Type 2 Preliminary Plat Approval shall be approved only if the Town Council or Planning Director, as appropriate, determines that the proposed subdivision: a. Identifies tree protection areas as required in Section 5.4.5, Tree Protection Plan and Tree Protection Areas; b. Complies with applicable standards in Article 5: Development Standards, Article 6: Riparian Buffers, Article 7: Stormwater Management, and Article 8: Performance and Maintenance; c. Complies with the provisions of the Statement of Voluntary Compliance in Section 5.9.7.B.2 of this Ordinance, if applicable; d. Complies with all other applicable standards in this Ordinance; and e. Complies with all other applicable Town ordinances and state and federal laws. (Ord. No. 2016-001, 05/10/2016) C. Final Plat Approval 1. Final Plat Approval Procedure The following subsections identify those steps in the standard review procedure (see Section 2.4) applicable to the review of a Final Plat Approval application and note any specific variations of, or additions to, those review steps. a. Pre-Application Conference The applicant shall hold a pre-application conference with Town staff in accordance with Section 2.4.2. b. Application Submittal and Acceptance The application shall be submitted and accepted, and may be withdrawn, in accordance with
Section 2.4.3, except that no application shall be submitted unless: (1) Type 1 Subdivision Preliminary Plat Approval or Type 2 Preliminary Plat Approval for the subdivision has been obtained and is unexpired and otherwise valid; (2) Construction Plan Approval for all public infrastructure and private utility improvements required has been obtained and is unexpired and otherwise valid; and (3) Construction or installation of the approved improvements has been ensured by one or a combination of the following: (A) Completion of the construction or installation of approved improvements and acceptance of the improvements by the appropriate agency; (B) Payment to the Town of funds in lieu of required street construction in accordance with Section 8.1.3, Alternatives in Lieu of Construction of Public Street; and/or
