Development Permit in accordance with 2.5.9, Floodplain Development Permit, and in full compliance with the provisions of Section 5.6, Floodplain Management. 3. The degree of flood protection required by the Floodplain Overlay District is considered reasonable for regulatory purposes and is based on scientific and engineering consideration. Larger floods can and will occur. Actual flood heights may be increased by manmade or natural causes. This section does not imply that land outside the Special Flood Hazard Areas and Future Conditions Flood Hazard Areas or uses permitted within such areas will be free from flooding or flood damages. This section shall not create liability on the part of the Town or by any Town officer or employee for any flood damages that result from reliance on Floodplain Overlay District regulations or any administrative decision lawfully made in accordance with such regulations.
