Sec. 34-1. Definitions

(1)

Aggressive Manner:

(a)

Approaching or speaking to a person, or following a person before, during or after soliciting if that conduct is intended or is likely to cause a reasonable person to fear bodily harm to oneself or to another, or damage to or loss of property or otherwise be intimidated into giving money or other thing of value;

(b)

Continuing to solicit from a person after the person has given a negative response to such soliciting;

(c)

Intentionally touching or causing physical contact with another person without that person’s consent in the course of soliciting;

(d)

Intentionally blocking or interfering with the safe and free passage of a pedestrian or vehicle by any means, including unreasonably causing a pedestrian or vehicle operator to take evasive action to avoid physical contact;

(e)

Using violent or threatening gestures toward a person being solicited;

(f)

Following the person being solicited, with the intent of asking that person for money or other things of value;

(g)

Speaking in a volume unreasonably loud under the circumstances;

(h)

Soliciting money from anyone who is waiting in line for entry to a building for another purpose.

(2) Public place or place open to the public: for the purpose of this article are defined as areas generally visible to public view and includes roads, streets, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, automobiles (whether moving or not), and buildings open to the general public including those which serve food or drink, or provide entertainment, and the doorways or entrances in buildings or dwellings and the grounds enclosing them. (3) Beg, ask, solicit: includes, without limitation, the spoken, printed or written word or other such acts as are conducted in furtherance of the purpose of obtaining money, alms or contributions. (4) Alcoholic beverages: for the purpose of this Chapter are defined as any beverage containing at least one half of one percent (0.5%) alcohol by volume, including malt beverages, unfortified wine, fortified wine, spirituous liquor, and mixed beverages.

(5) Malt beverages: for the purpose of this Chapter are defined as beer, lager, malt
