(8) If the group demonstration or picket line is to be sponsored by, or on behalf of, any person other than the applicant, the applicant for such permit shall file with the application a written authorization from the person proposing to hold the group demonstration or picket line authorizing the applicant to apply for the permit on their behalf. (9) A statement from the applicant acknowledging the conduct restrictions identified in section 54- 46.1. (Ord. No. 2023-6-0, 3-14-23).

Sec. 54-40. — Permit Fee.

A nonrefundable fee , as established in the Town’s user fees chart shall be paid by the person applying for the parade permit as a component of the special event permit at the time of application to cover expenses incidental to processing the application.

There is no fee assessed related to an application for a permit for a group demonstration or a picket line. (Ord. No. 90-42, § 4, 7-23-90; Ord. No. 2023-6-0, 3-14-23)

Sec. 54-41. Standards for issuance or revocation of parade permit.

A Special Event is a type of Temporary Use Permit and must meet the temporary use permit standards and the use-specific Special Event standards identified in the Town’s Uni form Development Ordinance and the Special Event application. (Ord. No. 90-42, § 6, 7-23-90; Ord. No. 2023-6-0, 3-14-23)

Sec. 54-41.1. Standards for issuance or revocation of group demonstration or picket line permit.

The police chief shall issue a permit for a proposed group demonstration or picket line unless there is a finding that:

(1) The anticipated conduct of the group demonstration or picket line will substantially interrupt the safe and orderly movement of pedestrians or vehicle traffic or the intended uses of a facility at or adjacent to the proposed assembly area. (2) The anticipated conduct of the group demonstration or picket line will require the diversion of so great a number of law enforcement personnel of the town to properly police and safeguard the assembly area of the group demonstration or picket line and of contiguous areas that adequate police protection cannot be provided to the remainder of the town. (3) The anticipated conduct or size of the group demonstration or picket line will require the diversion of so great a number of EMS, fire, or rescue units that adequate service to portions of the town and contiguous areas not occupied by the group demonstration or picket line will be impeded.

(4) The group demonstration or picket line is to be held for the primary purpose of advertising a product, goods, or an event and is designed to be held primarily for private profit or gain.
